The Lisbon Treaty introduced a new horizontal social clause in the text of the Treaty on the functioning of the European Union (article 9 TFEU) which states that in defining and implementing its policies and activities, the Union shall take into account requirements linked to the promotion of a high level of employment, the guarantee of adequate social protection, the fight against social exclusion, a high level of education and training and the protection of human health. After analyzing the function of the social clause in the processes of social and economic mainstreaming and its origin in the contest of the European Impact Assessment, in the essay the effectiveness, the objective and subjective scope and the binding content of the article 9 TFEU are examined.

Abstract
