The article focuses on the functions attributed to fundamental rights in the interpretation and the application of EU immigration and asylum law in the case law of the European Court of Justice. It enlightens some strands of the EUCJ case law which display the "fair balance" settled by the Court between the unfettered power of Member States and the constraints flowing from the European Charter and from the European Convention for the protection of fundamental rights (ECHR).
