People who suffer damage in a metaverse-related accident will likely face many obstacles in pursuing their claims. Obstacles for tort plaintiffs in cyber-tort cases are nothing new, but metaverse-related accidents present additional difficulties that deserve to be explored. This chapter examines the chances of potentially valid claims arising out of metaverse-related accidents in the United States and Europe. The argument proposed here is that metaverse companies can easily build up their immunity from tort claims in the US, but nevertheless remain exposed to claims originating in Europe. It is far from clear, however, whether this would help claimants located in other parts of the world.
