Basically, the aim of this paper is to address the question as to whether Italy is somehow internationally responsible for the gross human rights violations inflicted on migrants in Libya, namely while migrants are under Libyan jurisdiction. I will attempt to answer this question bearing in mind above all the general frame of the Draft Articles on Responsibility of States for International Wrongful Acts (DARSIWA) adopted in 2001 by the UN International Law Commission (ILC).
